Terms of Service
The ground rules for using this website, and a plain explanation of how our estimates, change orders, and warranties actually work.
1. Acceptance of these terms
These Terms of Service ("Terms") apply to sbjpainting.com and any page, form, or content on it. The site is operated by SBJ Painting LLC, 289 Chickasaw Drive, Walsenburg, CO 81089 ("SBJ Painting", "we", "us", "our").
By browsing this site or sending us a request through it, you agree to these Terms. If you do not agree with them, please do not use the site. Just call us at 719-285-9214 instead.
2. This website is informational
Everything on this site (service descriptions, project photos, blog articles, price ranges if any appear, and general advice about coatings and climate) is provided for general information. It is not a bid, not an offer to perform work, and not professional advice about your specific property.
Using this website does not create a contract for work between you and SBJ Painting. Sending the estimate form starts a conversation. It does not book a job, reserve a date on our calendar, or obligate either of us to anything.
3. Estimates are not binding contracts
We give free estimates, and we put them in writing. Here is what that does and does not mean:
- Any figure discussed by phone, email, or text before we have seen the property is a rough indication only.
- A written estimate is subject to an on-site inspection and to what we find when we get there: the condition of the substrate, previous coatings and how well they are bonded, rot, insect damage, chinking and caulk failure, moisture content, drywall or trim repairs, access and staging requirements, and anything hidden until prep begins.
- An estimate becomes binding only when both sides sign a written project agreement covering scope, products, price, and timeline. That signed agreement, not this website and not the estimate on its own, is the contract.
- Estimates are valid for the period stated on them. If none is stated, treat them as valid for 30 days, since material costs move.
- We may decline any project, for any lawful reason, before an agreement is signed.
4. Changes to scope and price
Once work is underway, any addition to or change in the agreed scope, and any resulting change in price or schedule, must be documented in a written change order that we both approve before that work is performed. We will not perform extra work and bill you for it after the fact, and we will not absorb work you added without telling us. If we uncover a hidden condition that changes the job, we stop, show you, and price it before continuing.
5. Warranties for the work itself
Nothing on this website creates a warranty. Descriptions of our process, our standards, or how long a finish "should" last are informational, not promises about your project.
Any workmanship warranty we offer is stated in the signed project agreement for that specific job, and that document governs. Manufacturer warranties on paints, stains, sealers, and other products belong to the manufacturer, on the manufacturer's terms. We will tell you what products we are using and pass along the manufacturer's coverage information, but we do not extend or guarantee it.
Coating life depends on things nobody controls: elevation and UV exposure, the direction a wall faces, roof overhang, moisture, drainage, the condition and species of the wood, prior coatings, and how the surface is maintained afterward. Normal wear, weathering, fading, and substrate movement are not defects.
6. Scheduling and weather
We work in the Colorado high country, and exterior painting, staining, and deck restoration are weather-dependent by nature. Coatings need surface and air temperatures in the manufacturer's range, dry substrates, and enough dry hours to cure. Rain, snow, wind, wildfire smoke, and big overnight temperature swings can and do move exterior schedules.
Any start date or duration we give you is a good-faith estimate. We will keep you informed and reschedule as soon as conditions allow. Delays caused by weather, material availability, access problems, or other events outside our reasonable control are not a breach of the agreement, and we are not liable for costs arising from them.
7. Accuracy of content and photos
We work hard to keep this site accurate, but we do not warrant that every detail is complete, current, or error free, and we may change service descriptions, articles, and photos at any time without notice.
Project photos are representative of work we have performed. Results vary by substrate and conditions. Color rendering also varies by screen, so never choose a final color from a photo on this site. We will get you real samples or a drawdown before we spray anything.
Reviews and testimonials shown on this site are the genuine opinions of the people who wrote them and describe their own projects. They are not a guarantee of the outcome on yours.
8. Intellectual property
The content of this site, including the text, layout, design, code, logo, and the project photographs, is owned by SBJ Painting LLC or used with permission, and is protected by copyright and trademark law. The SBJ Painting name and logo are our marks.
You may view the site and print or save pages for your own personal, non-commercial use, such as sharing a quote conversation with your spouse or an HOA. You may not copy, republish, scrape, mirror, or use our photos or copy on another website or in marketing materials without our written permission. Ask us. We are usually happy to say yes for a legitimate reason.
9. Acceptable use
When using this site, please do not:
- Submit false, misleading, or impersonated information through the contact form
- Use the form to send spam, solicitations, chain messages, or automated submissions
- Attempt to gain unauthorized access to the site, its server, or any connected system
- Introduce malware, or scan, probe, or stress test the site or its infrastructure
- Scrape or harvest content, contact details, or images by automated means
- Use the site in any way that breaks the law or infringes anyone's rights
We may block access, without notice, to anyone who does these things.
10. Third-party links and embedded content
This site links to third-party sites, including our Facebook page, and embeds a Google map on the contact page. Those services are run by other companies under their own terms and privacy policies. We do not control them, we do not endorse everything on them, and we are not responsible for their content, availability, or practices. What happens once you click through is between you and them. Our Privacy Policy and Cookie Policy explain what data those embeds can receive.
11. Disclaimer of warranties for the site
The website is provided "as is" and "as available". To the fullest extent permitted by Colorado law, SBJ Painting disclaims all warranties of any kind relating to the website, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error free, or that any content on it is accurate or reliable.
This section is about the website. It does not limit any warranty we give you in a signed project agreement, and it does not limit your rights under the Colorado Consumer Protection Act or other consumer protection laws that cannot be waived.
12. Limitation of liability
To the fullest extent permitted by law, SBJ Painting LLC and its owner, employees, and crew are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of this website, even if we were advised such damages were possible.
Our total liability for any claim arising out of your use of this website is limited to one hundred dollars (100 USD).
Again, this section applies to the website only. Liability arising from work we actually perform at your property is governed by the signed project agreement for that work and by Colorado law, and nothing here limits liability for fraud, willful misconduct, or personal injury or death caused by our negligence, or any other liability that cannot lawfully be limited.
13. Indemnification
You agree to indemnify and hold harmless SBJ Painting LLC and its owner, employees, and crew from any claims, losses, liabilities, and reasonable legal fees arising out of your misuse of this website, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Governing law and venue
These Terms and any dispute arising from them or from your use of this website are governed by the laws of the State of Colorado, without regard to its conflict of law rules. You and SBJ Painting agree that the exclusive venue for any such dispute is the state courts located in Huerfano County, Colorado, or a federal court with jurisdiction over Huerfano County, and you consent to the personal jurisdiction of those courts.
15. Resolving a disagreement
If something goes wrong, talk to us first. Most problems get solved with one phone call and a visit. Before either of us files anything, we ask that you contact Sean directly at 719-285-9214 or sean@sbjpainting.com, describe the issue, and give us 30 days to make it right. We will do the same before bringing any claim against you.
If informal resolution does not work, either of us may bring the matter in the Colorado courts described above. Small claims court remains available to either of us for claims within its limits.
There is no forced arbitration clause and no class action waiver in these Terms. We would rather sit down at your kitchen table than in a hearing room.
16. Severability and no waiver
If any part of these Terms is found unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in force. If we do not enforce a provision right away, that is not a waiver of our right to enforce it later.
17. Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and SBJ Painting regarding this website. For actual painting, staining, or restoration work, the signed project agreement for that job controls, and where it conflicts with these Terms, the project agreement wins.
18. Changes to these terms
We may update these Terms as our business or the law changes. The current version always lives at this address, with the "Last updated" date at the top. Continuing to use the site after we post a change means you accept it. Changes are not retroactive and do not alter a project agreement you already signed.
